On July 1, 2015 the company Bulinský & Vávra, advokátní kancelář, s.r.o., the legal successor to the original association of individuals Bulinský & Vávra, advokátní kancelář, was entered into the Commercial Register.

 

The Law Firm, with its long tradition, is one of the leading law firms in Brno providing legal services since 1 July, 1990 – i.e. from the very beginning of the existence of the private advocacy.

 

The Law Firm has built its reputation primarily for its specialization in providing legal services to foreign clients and clients with foreign capital participation.  The Law Firm has extensive experience mainly in the area of private international law and international trade law, principally acquired from long-term cooperation with prestigious international law firms and from long-term representation of foreign clients in the Czech Republic and of Czech corporations with foreign owners.

 

The Law Firm provides legal services in all areas of law with a special focus on commercial law, civil law and international private law. The legal services are provided to both - companies and individuals in Czech, English or German language.

 

The Law Firm is a member of the Association of German Attorneys VDA and was a long-time member of the international association of law firms EUROJURIS (more information on this can be found in the section International cooperation).

 

The Law Firm provides comprehensive legal services to business corporations including all corporate matters, preparation of commercial and employment contracts and other documents related to the daily business of the company (e.g. general terms and conditions, sample contracts etc.)

 

Another important field of provision of legal services is the area of contractual obligations, including contractual documentation for development projects, real estate purchase agreements together with escrow agreements and mortgage agreements; and lease and sublease agreements as well as enforcement of performance of such agreements at courts or arbitration courts.

 

The Law Firm also represents its clients in the family law matters, especially concerning the settlement of marital property. Further, the Law Firm represents clients in inheritance cases; particularly when dealing with inheritance abroad (mainly in Germany, Austria and US).

 

The Law Firm provides legal services and legal representation with regard to compensation of damages, including compensation of damages in connection with the international road transport (CMR).

 

In the Law Firm, there are lawyers specializing in employment law and resolution of labour disputes as well as lawyers specializing in mergers and acquisition of business corporations. Further due to long term cooperation with one of the leading insurance company, the Law Firm has extensive knowledge and experience in the area of insurance law.

 

Other services include organization of specialized training courses for our clients (such as major business corporations and others including chambers of commerce), with a particular focus on contractual obligations, corporate law, employment law or practical use of general terms and conditions.

 

The Law Firm also represents clients in criminal law cases (ex offo or based on a power of attorney). In this area the Law Firm specializes in economic crime law and traffic offenses.

 

Further, the Law Firm provides legal representation not only in courts or arbitration courts, but also when dealing with public authorities (such as cadastral office, building authority, customs authorities or the Office for the Protection of Competition which is located near our Law Firm).

 

Part of the Law Firm is composed of a separate department which deals with the collective management of recoveries and through which our Law Firm achieves rapid and efficient debt recovery.

 

The Law Firm is a long-time member of the Brno Regional Chamber of Commerce.

 

Since March 2013 the Law Firm has a branch office located in Vienna led by Mgr. Vávra. The Vienna office provides legal services to Czech entities in Austria, with a main focus on (i) recovery of receivables (application for European order for payment, subsequent enforcement of claims, insolvency proceedings applications etc.), (ii) establishment of business corporations or branches of Czech companies in Austria, (iii) legal representation in civil and criminal cases (including representation of victims in criminal cases) in Austrian courts, (iv) drafting and commenting on real estate purchase agreements and other agreements under Austrian law and (v) employment law including a issues in connection with the posting of workers etc.

SPECIALIZATION

Trusts

Our law firm provides comprehensive legal services and advice in relation to the trusts. Such legal services involve foundation of a trust and its subsequent administration, as well as all other related consultancy and advisory services related to the trusts.

 

What is a trust?

A trust is a set of property without legal personality that the founder has allocated from his exclusive assets and has handed it over to the trustee. Such allocated assets thus cease to be owned by the founder of the trust or by the person who puts it in, but becomes anonymous (so-called independent) property. During the existence of the trust, the ownership rights to the assets in the trust are exercised by the trustee, whose main task is to properly administer these assets.

The main principle of the trust is therefore management of the assets in the trust by the trustee in order to achieve the purpose of the trust.

 

For what purpose can a trust be established?

The trust can be set up for various purposes, whether public or private.

 

It can be used in particular as:

 • an instrument to protect family or business assets (e.g. protection of family assets in the case of a big family, unwanted heirs,

    to secure succession in business, etc.)

 • the safe and stable structuring of the future transfer of property to the family, etc.

 

What to do if you want to establish a trust?

First of all, it is essential to arrange a personal meeting with us in order for us to explain to you in detail the conditions for the establishment of the trust. During such meeting we will find out whether and what trust is suitable for you.

Consequently, if you agree to establish a trust, we will prepare the necessary trust documents for you. After your approval of such trust documents, we will set up a meeting with a notary who will (i) make a notarial deed on the founding of the trust and then (ii) register the trust into the Trust Registry. Once the trust has been registered it will legally come into existence.

Through cooperation with attorneys associated in EUROJURIS INTERNATIONAL (international association of middle sized law firms that unites attorneys from more than 40 countries all over the world and of which the Law firm was a member for several years - for more information please see www.eurojuris.net), the law firm Bulinský & Vávra, advokátní kancelář, s.r.o. is able to secure legal service abroad and to guarantee the quality and price of provided legal service to be in accordance with EUROJURIS INTERNATIONAL rules.

 

The Law firm is also a member of the Association of German Attorneys known as VERBAND DEUTSCHER ANWÄLTE e.V. (www.Verband-Deutscher-Anwaelte.de) where Mgr. Vávra acts as the Executive member.

 

Apart from the cooperation with attorneys in other countries through the above mentioned associations, the associates of the Law Firm also, when handling the clients’ matters abroad, closely cooperate with local attorneys. Such cooperation is based on a long term work and personal relationships.

BRANCH OFFICE VIENNA

Since March 2013 the Law Firm has a branch office located in Vienna. The Vienna office is led by Mgr. Vávra who provides here - at least 1x in 14 days - legal services to Czech clients in need of legal assistance in Austria (closely cooperating with the law firm pallas, coop-recht) and to Austrian clients seeking legal aid in the Czech Republic. However the main seat and focus of activities of Mgr. Vávra still remains in Brno.
